Postponing and cancelling a display

Definition

Postponement is the decision to fire the display on another date; cancellation, the decision not to fire it at all. The causes are wind beyond the set limit, thunderstorms, a prefectoral drought order, national mourning, a municipal ban or the organiser being prevented. The regulation provides no procedure for postponing CERFA 14098: a new date in principle requires a new declaration, unless the prefecture tolerates a postponement of a few days notified by email, which varies from one department to another. The contract must therefore settle in advance who decides, on which measurable criteria, and what happens to the money: retention of the deposit, invoicing of costs incurred, fallback date, fate of fireworks already withdrawn from stock. A display cancelled for an external cause qualifies as force majeure only if the cause is unforeseeable and irresistible, which seasonal weather is not always.

In practice, for the display company

Postponing a display means redoing a declaration, reassigning a crew, holding stock and informing an unhappy client, all within 48 hours.
