Definition
The service contract formalises the agreement between the pyrotechnician and the organiser beyond the price: it allocates obligations and responsibilities. On the pyrotechnician's side: supply of fireworks, qualified staff, CERFA declaration if entrusted to them, professional liability insurance, compliance with distances. On the organiser's side: provision of the site, obtaining municipal authorisations, keeping the safety perimeter clear, barriers and stewards, access to water and power, overnight guarding. The contract sets the wind limit beyond which the display is postponed, the financial terms of postponement and cancellation, the fate of unfired fireworks, late payment penalties and the competent court. With a local authority it often takes the form of a signed undertaking or a purchase order referring to a specification.
In practice, for the display company
The postponement and perimeter clauses are the ones that prevent August disputes.
