Who authorises: ATF at federal level, the AHJ and fire marshal locally
In the United States, display pyrotechnics falls first under the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), which enforces Title 27 of the Code of Federal Regulations, Part 555 "Commerce in Explosives". Anyone engaging in the business of importing, manufacturing, dealing in, receiving or transporting display fireworks must first obtain a federal explosives licence or permit. That federal layer never replaces the display permit: it sits on top of it.
The show itself is authorised by the authority having jurisdiction (AHJ): the state fire marshal, the county or city fire department, sometimes the police. The AHJ issues the display permit, inspects the site and can cancel the shoot for wind or drought. Requirements differ from state to state: California, for instance, licenses pyrotechnic operators itself through the Office of the State Fire Marshal and leaves display permits to local fire authorities, working from NFPA 1123 and Title 19.
What to file and when: ATF licence or permit, then the local permit
Federally, the company chooses between a licence (importer, manufacturer, dealer) and a user permit. The user permit lets you acquire explosive materials from licensees in another state or abroad and move them in interstate commerce; the dedicated form ATF F 5400.21 (Permit, User Limited Display Fireworks) is for operators who stay within their state. A limited permit allows receipt of explosive materials on no more than six separate occasions during its twelve months, from in-state suppliers only. Original licences cost $200 for three years and renewals $100 (27 CFR 555.42); permit fees are set in 27 CFR 555.43.
Responsible persons and employee possessors go through a background check (27 CFR 555.45). Locally, the display permit is applied for with the AHJ, with a site plan, shell sizes, an insurance certificate and the operator's identity; filing lead times run from a few days to several weeks depending on the jurisdiction and must be confirmed with the relevant fire marshal. There is no uniform federal lead time for a display permit.
Professional qualification: the operator licensed by the state
There is no federal pyrotechnician certificate; ATF licenses the business, not firing competence. NFPA 1123 requires a qualified operator approved by the AHJ, and states or cities decide what proof is needed: written exam, shoot log, references. In California a pyrotechnic operator must pass an exam, prove experience and supply written references from at least five licensed operators; the licence renews annually.
Other states impose no individual licence and rely on the AHJ approving the operator when the permit is issued. Before selling a show in a state where you have never fired, check with the fire marshal whether your home licence is recognised or whether a local exam is required.
Categories and thresholds: 1.3G display fireworks, 1.4G consumer fireworks, articles pyrotechnic
The federal definition is in 27 CFR 555.11. Display fireworks are large fireworks designed to produce visible or audible effects: salutes containing more than 2 grains (130 mg) of explosive materials, aerial shells containing more than 40 g of pyrotechnic composition excluding the lift charge; they are classed UN0333, UN0334 or UN0335. Consumer fireworks (ground devices of 50 mg or less, aerial devices of 130 mg or less, UN0336/UN0337) fall under the Consumer Product Safety Commission (16 CFR parts 1500 and 1507) and need no ATF licence or permit to be received or transported.
Articles pyrotechnic (UN0431/UN0432) are stage effects similar in composition to consumer fireworks but not intended for consumers: they too are outside ATF licensing. Storage follows 27 CFR 555.201 onwards: magazine types 1 to 5, display fireworks stored as low explosives, dedicated display fireworks distance tables in 555.221 to 555.224, and notification of the fire authority for the storage site, orally the same day and in writing within 48 hours.
Safety distances and site rules: NFPA 1123 and NFPA 1126
NFPA 1123, Code for Fireworks Display, sets the benchmark: the minimum radius of the display site is 70 feet per inch of internal mortar diameter of the largest shell fired, i.e. 420 feet (about 128 m) for a 6-inch shell. Non-splitting, non-bursting comets and mines containing only stars get half that, 35 feet per inch. The AHJ may demand more for wind, slope or surroundings. The 2026 edition has just been published; ask the AHJ which edition it has adopted.
For proximate effects, indoors or in front of a close audience, NFPA 1126, Standard for the Use of Pyrotechnics Before a Proximate Audience, applies: each device is separated from the audience by at least 15 feet or twice its fallout radius, whichever is greater, with 25 feet for concussion mortars. A demonstration in front of the AHJ is usually required before the first performance.
For transport, PHMSA (Department of Transportation) requires every device to be covered by an EX approval number; since 26 November 2021 APA Standards 87-1 A, B and C are incorporated by reference into 49 CFR, and a UN0335 display firework manufactured to APA 87-1 may be classed without prior examination (49 CFR 173.56 and 173.64). Road transport follows the 49 CFR hazmat rules: shipping papers, placards and driver endorsement.
Insurance and invoicing: AHJ requirements, sales tax by state
No insurance amount is fixed federally, but practically every AHJ requires a certificate of liability insurance naming the municipality as additional insured before issuing the permit. The limits requested vary widely from one city to the next: ask for the exact figure when you file and reflect it in your quote, because it affects the price.
There is no federal VAT and no mandatory e-invoicing in the United States. Each state applies its own sales tax, with its own rules on services and incorporated goods; some public clients are exempt and will supply a certificate. Clients will often ask for a W-9 form before paying. Contracts usually spell out postponement when weather exceeds NFPA 1123 limits and who bears remobilisation costs.
